1. Limited Warranty Coverage

HealthMerica, Inc. (“HealthMerica”) warrants to the original purchaser that the EaseFlow® main device will be free from defects in materials and workmanship under normal household use and when used in accordance with the EaseFlow® instructions for a period of one (1) year from the original date of purchase.

This warranty is a LIMITED WARRANTY and applies only as described in these terms.

2. What Is Covered

During the warranty period, this Limited Warranty covers defects in materials or workmanship affecting the normal operation of the EaseFlow® main device, including, when determined by HealthMerica to result from a covered defect:

  • failure of the internal pump;
  • failure of the power or control system;
  • failure of buttons, indicators, or other electronic components;
  • charging-system defects within the main device; and
  • structural or manufacturing defects in covered components supplied as part of the main device.

Coverage applies only when the product has been used, maintained, stored, and handled in accordance with the EaseFlow® instructions and safety information.

3. Warranty Period

The warranty period begins on the original date of purchase and continues for one (1) year.

Proof of purchase showing the purchase date may be required to obtain warranty service.

Repair or replacement under this Limited Warranty does not restart the original warranty period. A repaired or replacement product or component will remain covered for the remainder of the original warranty period or for any additional period required by applicable law.

4. What HealthMerica Will Do

If HealthMerica determines that a covered defect exists during the warranty period, HealthMerica will, at its option and without charge for the covered remedy:

  1. repair the defective product or covered component;
  2. replace the defective product or covered component with a new or functionally equivalent product or component; or
  3. provide another remedy required by applicable law.

Any replacement product or component may have minor cosmetic differences from the original product while providing substantially equivalent functionality.

5. What Is Not Covered

This Limited Warranty does not cover damage, malfunction, or deterioration caused by:

  • normal wear and tear;
  • accident, dropping, crushing, impact, or other physical damage;
  • misuse, abuse, neglect, or improper handling;
  • use contrary to the EaseFlow® instructions, warnings, or safety information;
  • improper storage or transportation;
  • exposure of components to water or other liquids in a manner not permitted by the product instructions;
  • improper charging, improper electrical supply, or external electrical damage;
  • unauthorized modification or alteration when the claimed defect or damage was caused by that modification or alteration;
  • repair or attempted repair when the claimed defect or damage was caused by that repair or attempted repair;
  • use of accessories, components, or supplies when the claimed defect or damage was caused by such items;
  • fire, flood, natural disaster, or other external causes beyond HealthMerica's reasonable control; or
  • cosmetic damage that does not affect the normal operation of the product.

This warranty does not cover products whose identifying information has been removed or altered in a manner that prevents HealthMerica from reasonably verifying the product, purchase, or warranty claim.

6. Disposable and Accessory Items

Disposable Guide Tubes are single-use consumable products and are not covered by this One-Year Limited Warranty.

Consumable or accessory items, including tubing, flow-control components, towels, carrying cases, charging cables, and similar accessories, are not covered by the one-year warranty for the main device unless the accessory itself is determined to have had a defect in materials or workmanship when originally supplied.

Nothing in this section limits any rights or remedies available under applicable law for products that are defective upon delivery.

7. How to Obtain Warranty Service

Please provide:

  • your name and contact information;
  • proof of purchase showing the original purchase date;
  • a description of the problem; and
  • photographs, video, serial number, lot information, or other reasonable information requested to help evaluate the claim.

HealthMerica may provide troubleshooting instructions before authorizing a return.

Do not return a product without first contacting EaseFlow® Customer Support and receiving return instructions.

If a return is required for evaluation of a warranty claim, HealthMerica will provide instructions regarding where and how the product should be returned.

For a valid covered warranty claim, HealthMerica will bear the costs of the warranty remedy and any shipping costs that HealthMerica is required to bear under applicable law or that HealthMerica expressly authorizes as part of the warranty service.

8. Limitation of Implied Warranties

To the extent permitted by applicable law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the duration of this written Limited Warranty.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Nothing in this Limited Warranty excludes or limits any implied warranty or other consumer right that cannot lawfully be excluded or limited.

9. Limitation of Incidental and Consequential Damages

To the extent permitted by applicable law, HealthMerica will not be liable under this Limited Warranty for incidental or consequential damages resulting from breach of this written warranty.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Nothing in this Limited Warranty limits liability that cannot lawfully be limited or excluded.

10. Relationship to Return Policy

This One-Year Limited Warranty is separate from the EaseFlow® Return & Exchange Policy.

The return policy governs eligible returns or exchanges during the applicable return period. This Limited Warranty addresses covered defects in materials or workmanship during the one-year warranty period.

Expiration of the return period does not by itself terminate an otherwise valid claim under this Limited Warranty.

11. Products Purchased From Authorized Sellers

For products purchased through an authorized retailer or reseller, the purchaser may contact either the seller or EaseFlow® Customer Support for information about obtaining warranty service.

Proof of the original purchase may be required.

This Limited Warranty does not alter any separate rights the purchaser may have against the seller under applicable law.

12. No Medical Guarantee

This Limited Warranty concerns the materials, workmanship, and covered operation of the EaseFlow® product only.

It does not constitute a guarantee of any particular health, medical, therapeutic, or physiological outcome.

13. State Law Rights

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

No provision of this Limited Warranty is intended to reduce, restrict, or eliminate consumer rights that cannot legally be waived under applicable federal, state, or local law.
